All users of the RPZ Flow platform (“Platform”) agree to the following:
All information submitted in connection with any backflow assembly test report must be complete, accurate, and truthful. The submitting party (tester and/or testing company) assumes full legal responsibility for the accuracy, completeness, and validity of all submitted data. RPZ Flow shall have no liability for errors, omissions, or falsified information.
By submitting any report, the testing company and/or individual certifies that all required licenses, certifications, and credentials are current, valid, and in good standing at the time of submission. RPZ Flow does not independently verify such credentials and disclaims all responsibility for invalid or expired licensing.
All backflow assembly data and reports associated with a water customer remain the property of the backflow assembly owner and/or governing water system.
By using the Platform, users grant RPZ Flow, LLC a perpetual, irrevocable, royalty-free license to store, process, reproduce, and transmit such data for operational, regulatory, and business purposes.
A non-refundable fee is required for each backflow test report submission and must be paid in full at the time of submission. Fees vary by water system and are displayed at checkout.
Failure to remit payment will result in rejection or invalidation of the submission.
Payments are processed via Clover. RPZ Flow does not store or have access to full credit card details. All transactions are encrypted and comply with applicable PCI-DSS standards. RPZ Flow shall not be liable for any third-party payment processor failures or breaches.
RPZ Flow may send automated notifications (via email, mail, or other methods) regarding testing deadlines. Delivery is not guaranteed, and failure to receive notification does not relieve any party of compliance obligations.
Where applicable, testers of record may receive reminder notifications prior to due dates. RPZ Flow makes no guarantee regarding the delivery, accuracy, or completeness of such notifications.
Upon successful payment, a digital (PDF) report will be generated and distributed to the applicable parties. This report constitutes the official record within the Platform.
Testing companies are solely responsible for complying with any additional jurisdictional requirements, including physical report delivery where required.
RPZ Flow supports submission of:
Reports for assemblies not currently in the system are subject to approval by the applicable water authority. RPZ Flow does not guarantee acceptance of any submission.
All Platform content, systems, workflows, databases, and processes are the exclusive property of RPZ Flow, LLC.
Unauthorized copying, reverse engineering, scraping, or replication is strictly prohibited. RPZ Flow reserves the right to pursue injunctive relief, damages, and all available legal remedies for violations.
Water systems and RPZ Flow reserve the right, at any time, to request documentation including but not limited to:
Failure to provide requested documentation may result in immediate suspension or termination.
All required testing must be completed and submitted before the due date specified within the Platform unless otherwise approved by the governing authority. RPZ Flow is not responsible for missed deadlines or resulting penalties.
Access to customer records requires a valid Location ID Number (LID). Testing companies are responsible for obtaining this from the customer.
RPZ Flow is not liable for unauthorized access resulting from misuse or sharing of LIDs.
To the maximum extent permitted by law, RPZ Flow, LLC shall not be liable for:
Use of the Platform is at the user’s sole risk.
Users agree to defend, indemnify, and hold harmless RPZ Flow, LLC from any claims, damages, liabilities, losses, or expenses arising from:
RPZ Flow reserves the right to suspend, restrict, or permanently terminate any account, without notice, for:
Termination may result in loss of access to the Platform and inability to submit reports in participating jurisdictions.
RPZ Flow reserves the right to modify these terms at any time. Continued use of the Platform constitutes acceptance of any updated terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict of law principles.
Any dispute not subject to arbitration shall be brought exclusively in the state or federal courts located in Illinois.
If a user or entity has entered into a separate written agreement with RPZ Flow, LLC, including but not limited to a Master Services Agreement (MSA), the governing law and venue specified in such agreement shall control.
By accessing, registering for, or using the Platform, the user agrees to be bound by these Terms through an affirmative action such as clicking “I Agree.”
Such acceptance constitutes a legally binding electronic signature under applicable law.
All disputes shall be resolved through binding arbitration administered by the American Arbitration Association.
Users waive:
Arbitration may be conducted remotely. The arbitrator’s decision shall be final and binding.
RPZ Flow may seek injunctive relief in court where necessary.
RPZ Flow’s total liability shall not exceed the total fees paid by the user in the twelve (12) months preceding the claim.
RPZ Flow shall not be liable for indirect, incidental, special, consequential, or punitive damages.
RPZ Flow shall not be liable for any failure or delay due to events beyond its reasonable control, including outages, cyberattacks, or government actions.
The Platform is provided “AS IS” and “AS AVAILABLE.”
RPZ Flow disclaims all warranties, including:
Nothing in these Terms creates a partnership, agency, or employment relationship. All users operate independently.
These Terms constitute the entire agreement between the parties.
RPZ Flow implements reasonable safeguards but does not guarantee absolute security.
Users acknowledge risks of data transmission. RPZ Flow is not liable for cybersecurity incidents, subject to Section 21.
If a user or entity has entered into a separate written agreement with RPZ Flow, LLC (including an MSA), that agreement shall govern in the event of any conflict.
